By accessing or using The Halligan (thehalligan.app), you agree to be bound by these Terms of Service and all applicable laws. If you do not agree with any part of these terms, you may not access or use this platform.

These Terms constitute a legally binding agreement between you and The Promotional Standard, LLC, a Colorado limited liability company ("Company," "we," "us," or "our"). Your continued use of the platform following any updates to these Terms constitutes acceptance of those changes.

The Halligan is an AI-powered assessment center practice and scoring platform designed for fire service and EMS professionals preparing for promotional examination. The platform provides:

• Oral board scenario practice with AI-generated feedback scored against the CLEAR rubric
• Role play simulations with voice-enabled AI interaction
• In-basket exercise practice and evaluation
• Session history, performance tracking, and bucket mastery analytics
• Optional live and asynchronous coaching services

The platform is provided for educational and professional development purposes only. It does not constitute formal examination preparation services, career counseling, or employment consulting.

All content, materials, and functionality within this platform — including but not limited to the CLEAR scoring framework, dimensional assessment methodology, scenario narratives, oral board prompts, role play scripts, in-basket exercises, AI-generated feedback, scoring rubrics, coaching content, audio content, visual design, and platform architecture — are the exclusive intellectual property of The Promotional Standard, LLC, protected under United States copyright law and applicable international treaties.

The CLEAR framework (Command, Leadership, Empathy, Analysis, Results) and all associated dimensional scoring methodology are proprietary works developed by The Promotional Standard, LLC. No license to use, reproduce, or derive from this methodology is granted by use of this platform.

AI-generated scoring feedback and scenario content produced by this platform are protected works. They are generated using proprietary prompt architecture and rubric logic owned by The Promotional Standard, LLC.

Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the platform for your personal professional development only. This license does not include the right to:

• Reproduce, copy, or distribute any platform content
• Use platform content to develop, train, or improve any competing product or AI system
• Resell, sublicense, or share account access
• Systematically collect, scrape, or harvest platform output by automated or manual means
• Reverse engineer the scoring methodology or prompt architecture

Any unauthorized use constitutes copyright infringement and may result in immediate account termination and legal action.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You may not share, transfer, or sell account access to any other person.

You agree to provide accurate and complete information when creating your account. The Company reserves the right to suspend or terminate accounts that violate these Terms, share access, or engage in prohibited conduct.

One account per person. Account sharing constitutes a material breach of these Terms and will result in immediate termination without refund.

All purchases are processed securely through Stripe. By completing a purchase you authorize The Promotional Standard, LLC to charge your payment method for the selected subscription tier.

Current subscription tiers and access periods are displayed at checkout. Access periods begin at the time of purchase.

Refund Policy: Due to the nature of digital educational content, all sales are final. Refunds are not issued for partial use, unused access periods, or dissatisfaction with promotional outcomes. If you experience a technical issue that prevents access to the platform, contact us at support@thehalligan.app within 7 days of purchase and we will investigate and remedy verified technical failures at our discretion.

The Company reserves the right to modify pricing at any time. Active founding member subscriptions are honored at their original rate for the duration of the access period purchased.

You agree not to use this platform to:

• Violate any applicable law or regulation
• Infringe any intellectual property rights
• Attempt to gain unauthorized access to any portion of the platform or its systems
• Interfere with or disrupt platform integrity or performance
• Upload or transmit malicious code
• Impersonate any person or entity
• Collect or harvest user data without consent
• Use the platform for any commercial purpose other than your own professional development
• Build, train, or contribute to any competing assessment center preparation product or AI system using content derived from this platform

Violation of these prohibitions may result in immediate account termination without refund and may expose you to civil and criminal liability.

The platform is provided "as is" without warranties of any kind, express or implied.

The Promotional Standard, LLC does not warrant that the platform will be uninterrupted, error-free, or free of harmful components. We do not warrant that any information provided through the platform is accurate, complete, or current.

Use of this platform does not guarantee promotion, employment advancement, or any specific outcome in any assessment center process. Promotional outcomes depend on individual effort, preparation, jurisdictional processes, and factors entirely outside the control of this platform.

The platform uses third-party AI services including but not limited to Anthropic Claude and ElevenLabs for content generation and voice interaction. The Company is not responsible for the outputs, availability, or changes to these third-party services.

To the maximum extent permitted by applicable law, The Promotional Standard, LLC, its officers, members, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to lost promotions, lost employment opportunities, loss of data, or loss of goodwill — arising from your use of or inability to use this platform.

In no event shall the Company's total liability to you exceed the amount you paid for your subscription in the twelve months preceding the claim.

Some jurisdictions do not allow limitations on implied warranties or liability for incidental damages, so the above limitations may not apply to you.

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Colorado.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
